If you are a California resident and you own a NOx rod furnace that was distributed under one of these brand names, then you may qualify for a corrective action program that has been instituted by the distributors of your furnace and approved by the United States Consumer Product Safety Commission ("CPSC"). Under the CPSC program, you may be entitled to a free inspection, repair or replacement of your existing furnace. For more information about this program and a description of the CPSC's concerns about the furnaces, you may review the PRESS RELEASE issued by the participating distributors.
You also may be a member of a settlement class certified by the Superior Court, Santa Clara County in Salah v. Consolidated Industries, Inc., Case No. CV 738376. Under the class action settlement, in addition to providing the CPSC remedy to current owners of eligible furnaces, defendants also provide a cash payment to former owners of eligible furnaces who replaced their furnaces on or before June 29, 2001.
For important information regarding your rights under the class action settlement, please review the summary Notice of Proposed Class Action Settlement, which explains your OPTIONS at this time. You should review the notice carefully, as it includes deadlines by which you must exercise your rights, such as your right to claim under the settlement (October 1, 2002). You may also view a complete copy of the Stipulation of Settlement approved by the Court.
You may use this website to:
- FIND OUT IF MY FURNACE IS INCLUDED IN THESE PROGRAMS if you know the brand name and model number of your furnace. If you do not know the brand name and model number, click HERE for assistance in locating it on your furnace and from other sources.
- REQUEST AN INSPECTION: If you have not previously replaced your qualifying furnace, then you may request an inspection and/or replacement furnace, as provided by the CPSC program, by clicking HERE. Alternatively, you may leave your claims information at 1-877-347-6456. (If you request the CPSC remedy on or before October 1, 2002, then you also will be deemed to have filed a claim in the Salah class action.)
- FILE A CLAIM FOR COMPENSATION FOR CERTAIN REPAIRS OR REPLACEMENTS: Under the class action settlement, a settlement class member who already has repaired or replaced his or her Furnace, at his or her own cost, may be eligible for a cash payment. For more information and to file a Claim Form, please click HERE.
- I HAVE A NOX ROD FURNACE IN A STATE OTHER THAN CALIFORNIA. The CPSC program and class action settlement only include NOx rod furnaces installed in California. However, we encourage you to provide us with information about your furnace. It will be forwarded to the company that distributed your furnace, and that company will contact you to discuss your options.
